On August 1, 2018 Dorsk Law Office, Plc made a motion to suppress and exclude evidence that was obtained improperly or illegally.
This motion prevented the prosecutor from using the evidence they had collected against my client which included the initial reason why he was pulled over.
The stop was invalid for the following reasons:
1. The officer testified that the defendant was bobbing and weaving in and out of traffic without signaling. However, the officer did not testify that traffic was obstructed by this behavior, nor did he provide evidence of my client’s speed.
2. The officer testified that the registration was expired but I argued that he didn’t provide physical proof at the suppression hearing which violated the Best Evidence Rule.
